& Conditions.
What you are ordering, what you get for it and when payment is due. Written so that they make sense without a lawyer at your elbow.
1. Who we are
The service is provided by (hereinafter referred to as the “Contractor”):

We are not VAT registered. The prices in the price list are final.
2. What you are ordering
The service consists of the design of a photo book from photographs you supply — selecting and ordering the frames, editing them, designing the spreads, typography and preparing the print files.
Printing and production of the book are not included in the price. At your request we will place the print order with the manufacturer of your choice; printing and delivery are charged separately at that manufacturer’s rates and may change if the specification of the book changes. Where we arrange the printing, its cost is paid to us in advance under Article 4.
3. How the contract is formed
- You send us an enquiry through the contact form or by e-mail.
- We go through your photographs and your idea of the book in a free consultation.
- We send you a quote setting out the agreed scope, format and schedule. The quote is valid for 30 days unless it states otherwise.
- The contract is formed by your acceptance of the quote — by signing the order or confirming by e-mail — and by payment of the deposit.
By confirming the order you confirm that you have read these terms and our Privacy Policy.
4. Price and payment terms
The price follows the current price list and the scope agreed in the quote.
- Before work begins you pay a deposit of 50 % of the design fee.
- The balance is payable once you have approved the final form of the book, before the print files are handed over. Where printing is arranged through Bab City Studio, 100 % of the agreed print cost is paid to us before the order is placed.
- Invoices are due within 7 days unless agreed otherwise.
- The delivery period starts once all material has been received and the deposit has cleared.
Full-resolution print files are handed over only once the price has been paid in full.
5. Scope of work and revisions
The price covers a design of 26 pages (13 spreads) and one revision round, that is one round of your comments. Each further spread and each further revision round is charged according to the current price list.
The design is normally delivered within 7 to 14 working days of all photographs being received. For larger projects the schedule is agreed individually.
6. Starter package
The Starter package is a sample of our work covering 5 spreads in the format of your choice, priced at 79.00 €. It does not include a revision round.
- Before work begins you pay a deposit of 50 % of the package price.
- The sample is supplied as reduced-resolution, watermarked files that are not fit for printing.
- If you express substantial dissatisfaction, the work goes no further: the deposit is not refunded — it is payment for work already done — and the balance is not payable.
- In that case no licence is granted to the sample or any part of it, and the previews supplied may not be reproduced, altered or published.
- If you approve the sample, you pay the balance and we agree the scope of the full book from the price list. The price of the Starter package is then credited against the cost of the subsequent work.
7. Delivery of the work
The work consists of the print-ready file, or the project uploaded into the manufacturer’s system. The work is deemed delivered when it is made available to the Client.
If no comments are received within 14 days of the work being made available, it is deemed approved without reservation.
8. What you are responsible for
By supplying the photographs you declare that:
- you are entitled to deal with them and that supplying them infringes no third party’s copyright;
- if they were taken by a professional photographer, you hold a licence covering their editing, use in a photo book and reproduction in print;
- the people shown are aware that the photographs will be used to produce the book and do not object;
- where anyone shown is under 16, you are their legal guardian or have that guardian’s consent.
We do not verify the origin of the photographs or your right to deal with them. If a third party brings a claim against us for infringement of copyright or personality rights in connection with the photographs supplied, you undertake to settle that claim and to compensate us for any loss incurred, including reasonable legal costs.
9. Copyright in the design
The design is a copyright work of referred to as the “Contractor”. On payment of the price in full you acquire a licence to use it for personal, non-commercial purposes, including having any number of copies printed for your own use.
Reselling the design or using it commercially requires a separate agreement.
10. Complaints
If the work does not match the agreed specification, write to sales@framebook.eu setting out precisely what you object to. We will acknowledge the complaint and deal with it within 30 days.
Where the complaint is justified, we remedy the defect free of charge, normally by amending the design. Where that is not possible, we will agree on a reasonable price reduction or issue a refund.
Complaints do not extend to the quality of printing and binding — that is the responsibility of the manufacturer with whom the print order was placed. Nor do they extend to the technical quality of the photographs supplied (resolution, sharpness, noise), which is beyond our control.
11. Withdrawal from the contract
The design is a work made to your specifications and from your materials. Where goods are made to a consumer’s specification, the consumer has no right to withdraw within 14 days without giving a reason (§ 18(1)(1) of the Austrian Distance and Off-Premises Contracts Act — FAGG); by confirming the order you expressly request that work begin and acknowledge this.
If you withdraw after work has begun, you pay a proportionate share of the price for the work done to that point; the deposit is credited against it.
A separate regime applies to the Starter package under Article 6 — there you may decide not to continue once you have seen the sample.
We may also withdraw if you fail to supply material even after a repeated request, or if the photographs are unlawful or contrary to public decency. In that case the deposit is refunded except for the part corresponding to work already done.
12. Data protection
We process your data and photographs as controller under the GDPR. The details — purposes, retention periods, recipients and your rights — are set out in our Privacy Policy.
Photographs supplied and working files are kept for 90 days after the work is delivered, the final print file for 12 months in case of a reprint. They are then permanently deleted, or earlier upon your written request.
For printing purposes the prepared files are passed to the book manufacturer. They are not made available to any other third party.
Publishing samples is not part of these terms. No part of your book will be published without your separate, freely given, written consent. Withholding or withdrawing that consent affects neither the price nor the scope of the service.
13. Governing law and dispute resolution
We will always try to resolve any disagreement amicably — e-mail is usually the quickest way.
Matters not covered by these terms are governed by the law of the Republic of Austria, in particular the General Civil Code (ABGB), the Consumer Protection Act (KSchG), the Distance and Off-Premises Contracts Act (FAGG) and the Copyright Act (UrhG). If you are a consumer habitually resident in another EU member state, this choice of law does not deprive you of the protection afforded by the mandatory rules of your country of residence.
If you are not satisfied with how a complaint has been handled, as a consumer you may turn to an alternative dispute resolution body. For disputes arising from orders placed online the competent body in Austria is the Internet Ombudsstelle (ombudsstelle.at); for other consumer disputes, Verbraucherschlichtung Austria (verbraucherschlichtung.at). Proceedings are conducted under the Austrian Alternative Dispute Resolution Act (AStG) and participation is voluntary.
Jurisdiction in disputes with a consumer is governed by mandatory consumer protection rules; a consumer may be sued only in the courts of their place of residence.
14. Final provisions
We may amend these terms. Orders already placed are always governed by the wording in force on the day the order was confirmed. The current version is always on this page with its effective date.
If any provision proves invalid, the remainder stay in force.
